How to fight drug possession charges in Texas

On Behalf of The Shapiro Law Firm | Aug 5, 2025 | Criminal Defense, Drug Crimes

Getting arrested for drug possession in Texas can turn your life upside down. One minute you are going about your day, the next you are facing charges that could affect your job, your family and your future. While it feels like everything is against you, there are defenses that might help you fight back.

Challenge the evidence against you

The prosecution must prove you knowingly had illegal drugs. If the authorities found the drugs in a shared space or if they belonged to someone else, it could weaken the case against you. Your lawyer can also challenge how the police collected the evidence. If police searched you or your property without a valid reason the evidence may be thrown out.

Prove you didn’t know about the drugs

You can’t be guilty of possession when you genuinely didn’t know drugs were present. Say a friend borrowed your jacket and left pills in the pocket, or maybe someone stashed something in your garage without telling you. This defense works best when you have solid proof like witness statements, text messages or security footage that backs up your story.

Show you had legal permission

Texas law allows you to carry certain controlled substances with a valid prescription. If officers arrested you for medication your doctor legally prescribed, presenting that prescription can lead to reduced charges or complete dismissal. Keep copies of all prescription paperwork and make sure the medication matches what’s on the bottle.

Start building your case now

Time matters when fighting drug charges. The sooner you begin preparing your defense, the more strategies you’ll have available. Strong cases often combine multiple approaches based on your specific situation. An attorney who knows Texas drug laws inside and out gives you the best shot at protecting your rights and future.

A charge does not equal a conviction. When you explore every possible defense, you create real opportunities to move forward without a criminal record weighing you down.
