Is there a difference between a DUI and DWI or are they the same thing?

In Texas, driving under the influence (DUI) and driving while intoxicated (DWI) are often used interchangeably in conversation. However, they are two different legal concepts, with a DWI being the most dangerous of the two.

Driving intoxicated

In Texas, DWI is the more serious offense and refers specifically to operating a motor vehicle while intoxicated. A person can be charged with a DWI if their blood alcohol level (BAC) is 0.08% or higher, or if they are impaired by drugs or alcohol.

Driving under the influence

Driving under the influence (DUI) is most likely the charge you have hear about the most. This one is still a serious charge and ultimately, both crimes can harm your present and future, which is why it is important to understand the limits of the law.

DUIs in Texas primarily applies to minors under 21, and they can be charged with DUI if they are found to be operating a vehicle. A minor can be charged with a DUI if they operate a vehicle with any detectable amount of alcohol in their sentence.
